Constitution Of Bar

CHAPTER – I
THE NAME OF ASSOCIATION
a.
The name of the association shall be “THE THANE DISTRICT COURTS BAR ASSOCIATION” located in District Court’s building, Thane.
b.
This constitution shall come into force from the date on which it is registered by the competent authority.
c.
The Association shall operate from all the Court’s within the territorial limits of the District of Thane.
PREAMBLE
WHEREAS THE THANE DISTRICT COURTS BAR ASSOCIATION HAS BEEN FUNCTIONING SINCE LAST MANY YEARS.

AND
THAT THE THANE DISTRICT COURTS BAR ASSOCIATION HAS ON ITS ROLLS ADVOCATES PRACTISING IN THE THANE DISTRICT COURTS.

HOWEVER
IT HAS COME TO PASS THAT THE THANE DISTRICT COURTS BAR ASSOCIATION HAS NOT BEEN REGISTERED AS AN ASSOCIATION.

AND
IN ORDER TO GIVE IT JUSTICE EXISTENCE IT IS NECESSARY AND ESSENTIAL TO GET THE SAID BODY REGISTERED UNDER THE INDIAN SOCIETIES REGISTRATION ACT.

AND
TO GIVE IT A WRITTEN CONSTITUTION
THE name of the association shall be “THE THANE DISTRICT COURTS BAR ASSOCIATION” located in District Court’s building, Thane.

AIMS AND OBJECTS OF THE ASSOCIATION
a.
To promote unity, goodwill and coordination amongst the members of the legal profession, the members of the judiciary and Litigants.
b.
To create and maintain feelings of brotherhood among the members of the Bar.
c.
To maintain status, prestige and high standard of professional ethics.
d.
To make representations to the High Court, Supreme Court, Parliament, State Legislature, and Central and State Governments with respect to the legislation, advancing the litigants grievances of the legal profession and litigating public and administration of justice generally.
e.
To send deputation’s arrange meetings, discussions, conferences etc. relating to legislation’s and other matters affecting the public in general and legal profession in particular.
f.
To represent and to protect the interests of the members of THE THANE DISTRICT COURTS BAR ASSOCIATION and the other Taluka Bar Association and Affiliate members.
g.
To promote and work for welfare of its members to implement and propagate group welfare schemes etc. for its members.
h.
To provide legal aid to deserving litigants.
i.
To build construct and maintain chambers of the buildings and alter, extend, improve, repair, enlarge or modify the same, and provide and equip the same with light, water, drainage, furniture, fittings, instruments, apparatus, and appliances and all other necessaries for use to which each building or chamber is to be put or held.
j.
To construct or otherwise acquire, layout, repair, extend alter, enlarge, improve and use the land, recreation or pleasure ground’s parks and/or any other immovable property belonging or held by the Bar.
k.
To construct, maintain, run, operate, a modern upto date library for the legal profession and primarily for its members.
l.
To accept and receive in any manner whatever any cash and immovable property either unconditionally or subject to any special trust created by any particular donor in furtherance of any one or more of the objects of THE THANE DISTRICT COURTS BAR ASSOCIATION.
m.
To print, publish and exhibit any books, pamphlets or posters that may be considered desirable for the promotions of THE THANE DISTRICT COURTS BAR ASSOCIATION.
n.
To draw, make, accept, endorse and discount cheques or other negotiable instruments.
o.
FOR the purpose aforesaid to sign, execute and deliver such assurance and deeds as may be necessary cooperate with judiciary and all other organizations interested in the administration of justice so as to make justice more readily accessible to poor persons or to persons of limited means, to reduce the cost, delays and hardships of litigants.
p.
To take all necessary steps to prevent to remedy any abuse of law or maladministration of justice.
q.
To do all such things as are incidental or conducive to the attainment of the above objects.

CHAPTER – II
MEMBERSHIP
1.
Membership of the “THE THANE DISTRICT COURTS BAR ASSOCIATION” shall be open to :
a.
All Advocates who are generally practicing of all/or any courts at Thane District including Civil, Criminal, Labour and Tribunal Courts shall be eligible to become a member of the Association.
b.
The Advocates or Practitioner desiring to be a member of the Association shall apply in writing to be enrolled as a member, to the Hon. Secretary in the prescribed form.
c.
The Hon. Secretary shall place such application before the Managing Committee of the Association for acceptance at the earliest. The Managing Committee may in its discretion accept or reject such application without assigning any reason.
d.
On acceptance of such application by the Managing Committee applicant will be informed about the decision of the Committee. If the application is accepted by the Managing Committee the applicant shall pay his annual or monthly subscription immediately, failing which the application stands rejected.

There shall be three categories of Members
A.
LIFE MEMBERS
B.
ORDINARY MEMBERS
C.
AFFILIATE MEMBERS
3.
FEES
a.
One time Lump sum fees as prescribed by the Managing Committee from time to time.
b.
Entrance fee to be paid by the prospective member as prescribed by the Managing Committee from time to time.
c.
Monthly subscription to be paid by the member or as prescribed by the Managing Committee from time to time.
4.
DURATION OF MEMBERSHIP
a.
A Life Member shall be a Member for life unless such a Member fails to abide by the Rules and Regulation of the Association, or ceases to be a member, by reason of termination of members by the THANE DISTRICT COURT BAR ASSOCIATION, or the Bar council suspends, cancels the stand of the member.
b.
An ordinary member who pays the membership fees regularly and agrees to abide by the Rules and Regulations of THE THANE DISTRICT COURTS BAR ASSOCIATION shall be entitled to continue as a Member of THE THANE DISTRICT COURTS BAR ASSOCIATION, unless his/her membership is terminated.
c.
Affiliate member shall be the Taluka Bar Association that operates from any courts on the limits of Thane District and the President/Secretary of the said Taluka/other Bar Association shall be ex-officio member of THE THANE DISTRICT COURTS BAR ASSOCIATION
(i)
Such member shall have no right to vote in any meeting of THE THANE DISTRICT COURTS BAR ASSOCIATION.`
(ii)
Such President/Secretary shall be member of THE THANE DISTRICT COURTS BAR ASSOCIATION till he/she espectively President/Secretary of such Taluka or any Bar Association, of any court within the Thane District.
5.
TERMINATION OF MEMBERSHIP
a.
A member shall be cease to be a member of THE THANE DISTRICT COURTS BAR ASSOCIATION, if:
(i)
A member has failed to pay subscription dues continuously for a period of six months or more.
(ii)
However, before terminating such membership on the grounds of non-payment of Membership fees, the member shall be given a chance by giving a seven days notice in writing to pay all the arrears upto date and if he/she fails to do so, the association, may take necessary action to remove him from membership and to recover the dues and such member shall not be allowed to use the facilities provided by THE THANE DISTRICT COURTS BAR ASSOCIATION.
(iii)
If the member resigns from the membership after paying all the dues.
(iv)
Any member of the association shall cease to be ________________ disallowed, debarred from practice in the Court of law, by the Bar Council of Maharashtra and Goa and/or any other competent authority.
(v)
The membership of any member who has contravened the provision of the constitution of THE THANE DISTRICT COURTS BAR ASSOCIATION or committed breach of the Rules and Regulation of the association so as to cause prejudice to the interest of the Association, or, for commission or omission of any act detrimental to the interest of the Association or derogatory to the legal profession, may be terminated by majority of 2/3of the total membership of the Association that is present at the time of General or Special meeting.
(vi)
The managing committee shall, before proceeding to take the matter of the termination of such membership on the Agenda, issue a show cause notice to such member/s as to why his/her/their membership should not be terminated.
(vii)
Such member/s who has/have received the show cause notice shall reply within a period of 15 days of receipt of such notice and in event he/she/they fail to reply and/or satisfy the Managing Committee shall then proceed to keep the matter on the agenda of the next General Meeting, along with its recommendation.
6.
PROVISION OF LOCKERS
a.
Fees for lockers shall be paid by the member as prescribe by the Managing Committee from time to time.
CHAPTER – III
MEMBERSHIP
1.
All the members of the Association for the time being shall constitute a General Body
2.
The Association shall have the following office bearers:
a.
PRESIDENT
b.
VICE-PRESIDENT
c.
HON. SECRETARY
d.
TWO JOINT SECRETARY (One Post Shall Be Reserved For Ladies)
e.
TREASURER
3.
The office bearer shall be the member of the Association and shall be elected by the General Body at its meeting. The election shall be by secret Ballot. No proxy shall be allowed at these elections. However postal ballots may be allowed by the election officer so appointed by the Managing Committee.
4.
There shall be Executive Committee consisting of five members to carry out General Management of the business of the Association and it shall be subject to the control of the President of the Association.
5.
The other members of the Executive Committee shall be elected by the General Body from time to time. The Election of these members shall be by Ballot. No proxy shall be allowed at these elections.
6.
Hon. Secretary and Joint Secretary of the Association shall be the Members of the Executive Committee by virtue of there and Hon. Secretary shall act as a Secretary of the Executive Committee.
7.
There shall be a Chairman of the Executive Committee who shall be elected as its first meeting after every election.
8.
The tenure of office bearers and the members of the Executive Committee shall be two years.
9.
The office bearers and the Members of the Executive Committee shall be elected by the General Body provided that the office bearers and other members of the Executive Committee shall continue to hold office even after the expiry of the tenure of two years till fresh election are held by the General Body.
10.
Office bearers and the members of the Executive Committee shall continue to be in office till they cease to be a member by reason of death, Resignation, cease to be member/s in his/her/their respective places.

11.

There shall be a coordination committee consisting of:

The Hon. Secretary

The President/Secretary Of Each Affiliate Taluka Bar Association Or Other Member As Nominated By The Said Taluka Bar Association.
a.
This committee shall meet once every three months or on the requisition of any member of the coordination committee.
b.
The meeting will be held at any Taluka Bar Association by rotation.
c.
The committee shall function as coordinating body between The Thane District Bar Association And Taluka Bars to enable uniformity of action taken by Members in respect of grievances or problems faced taken by The Thane District Bar Association or any Taluka Bars.
12.
There shall be a Hon. Auditor who shall be appointed by the Office Bearers and the Executive Committee in respect of verifying the accounts for previous years and to submits his report to the next Annual General Meeting.
13.
The present Body of the Office Bearers and Executive Committee continue to hold office under the New constitution upto June ______be Body of new Office Bearers for the year ____for which the election be held on or before June____
a.
The first election for the post of the Treasurer shall be held in the election to be held for the new body in ______.
ELIGIBILITY
a.
No Member shall be eligible for the post of President and Vice-President unless he/she has been a practicing Advocate and member of the Thane District Bar Association for the period of at least 20 years immediately prior to such election.
b.
No member shall be eligible for the post of Secretary unless he/she has a practicing Advocate and Member of the Thane District Bar Association for the period of at least 15 years immediately prior to such election.
c.
No Member shall be eligible for the post of Joint Secretary and Treasurer unless he/she has been a practicing Advocate and member of the Thane District Bar Association for the period of at least 10 years immediately prior to such election.
d.
No Member shall be eligible for the post of Member, Managing Committee unless he/she has been a practicing Advocate and member of the Thane District Bar Association for the period of at least 3 years immediately prior to such election.
14.
Every member of the thane district bar association who has completed continuous six months membership is entitled to vote in the election provided such member has paid his entire outstanding dues including the dues towards liberty fees, and or any other charges towards the Association.
15.
The name of the candidates, who are eligible to be elected to any of the said posts, shall be submitted with their written consent, to the President/Election Officer of the Association, duly proposed by two members and seconded by two other members, who are eligible to vote in the election of the Association, on or before the date notified by the Managing Committee. A member shall not be eligible to contest for any post if such member is in arrears of dues to be paid To The Thane District Courts Bar Association on the date of filing of nomination forms.
a.
This date of election shall be notified by the Managing Committee with consultant of President, an Election Officer appointed by the Managing Committee, at least three weeks in advance of the date of the B-Annual Election.
16.
A member shall be eligible to contest only for any one of the posts for which the elections are held and if such member files nomination for more than one post, all his nomination forms shall stand rejected and his deposit forfeited.
17.
The Election Officer shall arrange to have the nomination papers for these election, scrutinized and shall also fix a date for withdrawal, if any, and his election shall be held at least seven days after the date of withdrawal.
18.
a.
A member wishing to contest the election shall deposit the sum of security deposit along with his nomination form.
b.

The following respective minimum sum as deposit, and the Managing Committee shall have the right to increase the said deposit from time to time.
For the post of President Rs.1, 500/-
For the post of Vice-President Rs.1, 500/-
For the post of Secretary Rs.1, 000/-
For the post of Jt. Secretary/Treasurer Rs.750/-
For the post of Member of Executive Committee Rs.500/-

c.
The security deposit shall be non-refundable.
NOMINATION TO THE ELECTION
a.
A member shall be entitled to propose/second only one candidate foe any post, and at time of security of nomination forms, if its is found that a member has proposed/seconded more than one person such candidate/nominated person who has filed nomination at the earlier be accepted the other such candidate/s proposed/seconded by such member shall be rejected.
b.
When no valid nomination are received for any of the post then outgoing Managing Committee may suggest for the post/s availing which General Body of the Association shall fill such vacancies by their election by show of hands in the annual General meeting. If the election for whatsoever reason cannot be held at the date fixed the Managing Committee may postpone the date of election foe a period of not exceeding 30 days. The Office Bearers of the Managing Committee shall continue to function till the new body is elected.
CHAPTER – IV
THE POWERS AND FUNCTIONS OF THE PRESIDENT
a.
The president shall preside over the meeting of General Body or Special Body and shall exercise general control over the Hon. Secretary and Treasure, Joint Secretary, Executive Committee of The Thane District Court Bar Association.
b.
The Vice-President shall carry on his duty as President in the absence of the President provided that in absence of both, i.e. the president and Vice-President the chairman of the Executive Committee, and in his absence the senior most in age of the Executive Committee shall act as the President.
c.
Any temporary vacancy in the Executive Committee may be filled in by the Executive Committee with consultant of the President by co-option. The co-opted member shall continue to be a member of the Executive Committee till another new member is elected in his place.
d.
If a President or a Vice-President ceases to be such foe any reason the Hon. Secretary and Treasurer shall convene meeting of the General Body within three weeks to elect a new President or Vice-President as the case may be.

THE POWERS AND FUNCTIONS OF THE HON. SECRETARY

a.
The Hon. Secretary and the Hon. Joint Secretary shall work in cooperation with each other and in consultant with or under the instruction of the President, they shall be responsible for efficient working of the Association.
b.
The Hon. Secretary shall be the Administrative officer of the Association. It shall be his duty to cell all members at the meeting of the Association, in consultant with President, to keep record and proceedings of the Association to complete and maintain accurate list of members, to issue proper notices of all the meetings, to carry on correspondence on behalf of the Association and to carry out other Administrative function of the Association and such other work and duties as may be prescribed and entrusted by the Association, and, or by the President from time to time.
c.
The Hon. Secretary and Joint Secretary with consultation of the President of the Association will arrange social and __________ lecture gathering of members, arranging for send off, etc.
THE POWER AND FUNCTION OF HON. TREASURER
a.
Hon. Treasurer shall keep in custody the property and fund of the Association, cause to be maintained accounts and property and funds of the Association. Maintained and caused to be maintained in separate account of special subscription collected from the members under Chapter IIIC 4 and in general also maintain day to day accounts of the Bar Association.
b.
The Joint Secretary shall carry out the duties of secretary and treasurer in absence of later.
c.
Financial year of the Association shall be from 1st April to 31st March every year.
CHAPTER – V
MEETING OF THE ASSOCIATION
1.
GENERAL BODY MEETING
a.
The Annual General Meeting of the Association shall be hold every year within two months from the election of New Body.
b.
The Managing Committee shall lay before the meeting the annual Report and statement of Accounts for the previous year ending 31st March on or before 31st July for discussion and approval and unless otherwise ____ by the exceptional circumstances, in which event, the Managing Committee shall ___ the Annual Report and the statements of Accounts together with the reasons for such delay within a period of three months.
c.
The Quorum for such meeting shall be 60 members if no quorum is formed within 15 minutes of the stipulated time of meeting, then the meeting shall stand adjourned for 15 minutes on the same day. After adjournment of the meeting, the meeting will be held immediately and no quorum in necessary.
d.
Notice of the Annual General Meeting shall be published on the Notice Board at least 14 days prior to the date of the meeting. Fourteen days shall be deemed to be sufficient and proper notice to the members of Association.
e.
All questions at the Annual General Meeting shall be in the form of propositions and shall be decided by show of hands and by simple majority of votes of the members present at the meeting, unless voting by ballot/poll is demanded in the meeting by at least 10 members.
f.
The President-cum-Chairman at General Meeting shall have a casting vote in addition to his personal vote whenever such need arises.
g.
A Resolution is passed or rejected at any Ordinary General Body Meeting of the Association Shall not be reconsidered or repeated so as to have it altered, amended or modified within a period of six month from that date of such resolution, unless a meeting foe the purpose is convened on a requisition made and signed by not less than 100 members of the Association and notices of seven clear days of the meeting shall be displayed on the notice board. The decision at such meeting shall be taken by majority of 2/3 rd members present at the meeting.
h.
All meeting of the Association shall be held at such place and time as the Managing Committee may decide in consultation with the President from time to time.
2.
SPECIAL MEETING
a.
The Managing Committee may ___ or on requisition is writing of 100 Members of the Association call a special Meeting wherein business transaction shall be in the Agenda.
b.
The notice together with Agenda of Special Meeting shall be given to the members at least seven days in advance of the date of the meeting. The display of such notice on the Notice Board for continuous period of seven days shall be deemed to be sufficient and proper notice to the members of the Association.
3.
EXTRA ORDINARY GENERAL MEETING
a.
The Extra-Ordinary General Meeting of the Association may be called by the Hon. Secretary in consultant with President or on the requisition in writing by 100 members of the Association within 24 hours of the urgency so requires. In such meeting no other business expect that mentioned in the Agenda shall be transacted. And the provision of the CI(g) of para 1 ch. VI shall not operate as a bar to any such resolution of such meeting.
4.
MEETING OF THE EXECUTIVE COMMITTEE
a.
Meeting of the Executive Committee shall be held at least once in a month or as often as may be necessary.
b.
The quorum at the Executive Committee meeting shall be five members.
c.
The notice of Executive Committee shall be given to the members at least three days before the date of meeting.
SUB-COMMITTEE MEETING
a.
The Executive Committee Meeting may appoint from time to time a sub-Committee for specific purpose consisting not less than three members of the Managing Committee and may from time to time determine which if their Body shall be members of any such Committee so appointed and may at any time modify, dissolve or re-constitute such dub-Committee.
CHAPTER – VI
1.
PROPERTY OF THE ASSOCIATION CONSIST OF
a.
Property belonging to the Association at the Commencement of this Constitution (a list of which shall be prepared by Hon. Secretary and Treasurer) place before next meeting to Managing Committee for approval
b.
Any property for the purpose of the Association out of its funds or otherwise.
c.
Special Subscription from the members constitute special funds.
d.
Donations.
e.
Any property acquired from other source.
2.
APPLICATION OF FUND
a.
The income and property in of the Association which shall be mainly from subscription of the members, donation and from other source whatever shall be applied solely towards the promotion of the aims and objects of the Association as set forth in the constitution and no portion thereof shall be paid or transferred directly or by way of profit ti the members of the Association.
3.
RULES AND REGULATIONS
a.
The Association in a General Meeting may make Rules and Regulation for the purpose of giving effect to the provision of this constitutions provided that notice calling the General Meeting shall contain the proposed Rules and Regulations. All such Rules and Regulations will be attached to this Constitution as schedules thereto.
4.
BYE-LAWS
a.
The Managing Committee may form and repeat bye-law for the management and business and working of the Association provided that such bye-law shall not be in consistent with the provision of the Constitution and Rules and Regulation may for the Association from time to time.
5.
AMENDMENT TO THE CONSTITUTION
a.
This constitution may be amended by ¾ th majority of the members present at any such Meeting of the Association, provided that the notice of the meeting consisting the proposal to amend or amendments shall be ______ on the notice board at least fourteen days in advance. That 100 members shall constitute the Quorum for the transaction at such meeting.
b.
The above provision as to the Quorum and requisite ____ shall mutatis mutandis apply even at the adjourned meeting.
6.
AMENDMENT TO THE RULES AND REGULATIONS
a.
Rules and regulations mad in pursuance of this constitution may be mentioned by 3/ 4 majority of the members present at the meeting of the Association, provided the notice of the meeting containing the proposal to amend and general character of the proposal amendment or amendments, 60 members shall constitute a Quorum for the transaction of the business at such meeting.
b.
The above provision as to the Quorum and majority shall mutatis mutandis apply even at the adjournment meeting.
7.
GENERAL
a.
This Association may be dissolve by resolution passed by General Body at the Extra-Ordinary General Body Meeting especially called for this purpose with 30 days clear notice in writing to all eligible members of the Association to that effect is adopted by 3/4 of the members present at the meeting and voting. That the total voting in favor of the said dissolution is not less than or more than 50% of the members eligible to attend the meeting and upon adoption of the said resolution the assets of the Association shall be distributed as provided for in the provision for in the provision of the Societies Registration Act.
